Waivers

SUP/KAYAK Tour Waiver

I understand and acknowledge that water activities are dangerous and that enclosed flat water/waves/ocean can act in a sudden and unpredictable (changeable) way, which may result in serious injury to myself.

I agree to listen to my coach’s at all times and abide by their rules and safety guidelines

Personal swim ability
  • I can swim more than 25 metres and am confident in the water Medical history/personal injuries
  • I acknowledge that I am fit and healthy and any prior injuries/medical history will be noted below Equipment
  • I acknowledge that I am solely responsible for obtaining all advice or information necessary for the safety of, and the safe use of the kayak and the Stand Up Paddle Equipment.
  • I agree to where my PFD at all times while on or near the water
  • I agree to wear a leg-rope at all times and am familiar with correct use, helmet and of the leg-rope including quick release. And that the Hirer has provided a coiled leg-rope for enclosed flat water and exposed water locations and a long leg-rope for surf locations. I understand, and am to apply, the correct use of leg-ropes.
  • I assume all risks and liabilities in respect of the Kayak & Stand Up Paddle Equipment and for injuries to and death of persons and damage to property arising from the possession use or storage of the Kayak or Stand Up Paddle Equipment.
Damage to Kayak / Stand Up Paddle Equipment:

I agree that if I damage the equipment that I will be obligated to replace said equipment

Release of Liability

I understand that my signature to this document constitutes a complete and unconditional release of all liability of the proprietors of Mid Ireland Adventure and its employees and agents to the greatest extent allowed by the law in the event of me or others, suffering injury or death arising from my possession, use and storage of the Kayak or Stand Up Paddle Equipment.

Kayak/ SUP RENTAL AGREEMENT AND POLICIES

I hereby acknowledge and agree to the following rental agreement terms and conditions: Kayaks/SUP Boards are rented out clean and in proper working condition and must be returned in the same manner.

Wetsuits, paddles, and buoyancy aids are included in the rental, and are requires to be worn at all times while rented from Mid Ireland Adventure. If a customer is seen paddling the rental kayak or SUP board without a buoyancy aid they will immediately have to return the equipment with no refund.

Our kayaks/Sup boards are maintained on a daily basis. It is the responsibility of the client to check the equipment at the store BEFORE setting it out.

Customer agrees to return the kayak/Sup board in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for the repair, maintenance, or replacement. Customer accepts the use of the equipment, AS IS, in good condition and accepts full responsibility for the care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and the customer agrees to pay regular shop rates and retail prices for components replaced. The clean condition means normal wear and tear is accepted but does not include broken or lost paddles.

Customer agrees to provide Mid Ireland Adventure with credit card details, for precautionary use only:  I authorize Mid Ireland Adventure to charge the credit card they have on file for me for all eventual costs in case of damages to the kayak/Sup board in during my rental period, comprehensive of labor, except in the case that I can demonstrate other’s faults with evidence and all necessary information for reimbursement. In case of theft, I will be responsible for reimbursing Mid Ireland Adventure for the original price of the bicycle(s), plus the cost of any accessories that were provided at the time of the kayak/Sup board.

ID

Hirers must provide identification showing permanent address (photo license or similar) and car registration number. The right to hire is at the discretion of Mid Ireland Adventure. Returns after stated return time, there will be an additional charge of €10 half-hour overdue.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

Assumption of Risk: I understand and accept that renting this kayak/Sup board in and participating in water sports exposes me/my child to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property.

I also understand I/my child should be in good physical health to participate in water sports, and I confirm that I/my child has no significant health issues that prevent me/my child from participating in bicycling. I/my child has no medical conditions, nor have I/my child been diagnosed with a condition that prevents me from bicycling.  In spite of the aforementioned risks and acknowledgments, I hereby assume all risk of injury or loss of life to myself/my child and loss of or damage to property arising out of renting this bicycle and participating in bicycling.

I understand the inherent risk involved in using this rental kayak/Sup board equipment and accept full responsibility for any and all such damage or injury, which may result.

Waiver And Release: In consideration of Mid Ireland Adventure bikes renting me/my child this bicycle, I specifically release and forever discharge Mid Ireland Adventure and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I/my child may suffer while renting this kayak/Sup board in and participating in water sports.

This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death, or damage caused by the negligence of Mid Ireland Adventure or its affiliates, officers, agents, or employees. It is my intent by the Waiver And Releases Agreement to release Mid Ireland Adventure and hold it harmless from all liability for any such property loss or damage, personal injury, or loss of life, whether caused by the negligence of Mid Ireland Adventure or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document,

I fully recognize that if injury, illness, death, or damage occurs to me/my child while I am engaged in renting this,I will have no right to make a claim or file a lawsuit against Mid Ireland Adventure or its affiliates, officers, agents or employees, even if they or any of them negligently cause my injury/my child’s injury, illness, death or damage.

I realize the importance of wearing a buoyancy aid. Buoyancy aid must be worn at all times.

I understand that this activity may result in severe injury, including but not limited to spinal or head injury.

I understand that this activity may result in hazards posed by other water users and traffic or water conditions.

Mid Ireland Adventure Bikes & staff have answered any questions I have had. I understand these kayaks/sup boards may not have visibility enhancement equipment such as blinking lights.

MOUNTAIN BIKE TOUR WAIVER
MOUNTAIN BIKE WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY & WAIVER OF CERTAIN LEGAL RIGHTS

Read Carefully, this is a release of liability & wavier of certain legal rights.

 

  • The person who is participating in mountain biking with Mid Ireland Adventure shall be referred to hereafter as “Participant’. The “Undersigned means only the Participant when the Participant is 18 years or older or it means both the Participant and the Participant’s parents or guardian when the Participant is under the age of 18 years. The Undersigned agree and understand that participating in mountain biking, hiking, and traveling to and from the activity site (hereafter the Activity’) can be HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY AND/OR DEATH.
  • The Undersigned agree and understand that there are dangers and risks associated with participating in the Activity and INJURIES AND/OR DEATH may result from engaging in the Activity. The Undersigned agree and understand that risks include but are not limited to, the following: Changing weather conditions, hidden obstacles, equipment failure, dehydration, sunburn, driving or riding to and from the Activity site, and mental distress from exposure to any one of the above.
  • The Undersigned acknowledge and understand that the description of the risks listed above is not complete and that participating in the Activity, whether or not described, may be dangerous and may include risks that are inherent and/or which cannot be reasonably avoided without changing the nature of the Activity. By signing this document, the Undersigned recognize that property loss, injury, serious injury, and death are all possible while participating in the Activity. RECOGNIZING THE RISKS AND DANGERS, THE UNDERSIGNED UNDERSTAND THE NATURE OF THE ACTIVITY AND VOLUNTARILY CHOOSE FOR PARTICIPANT IN AND EXPRESSLY ASSUME ALL RISKS AND DANGERS OF THE ACTIVITY, WEATHER OR NOT DESCRIBED ABOVE, KNOWN OR UNKNOWN, INHERENT OR OTHERWISE.
  • Additionally in consideration for allowing the Participant to participate in the Activity, THE UNDERSIGNED HEREBY AGREE NOT TO SUE Mid Ireland Adventure or any of their respective successors in interest, affiliated organizations and companies, insurance carriers, agents, employees, representatives, assignees, officers, directors (each hereafter a ‘Released Party’) for any property damage (including but not limited to equipment damage), injury or loss to Participant, including death, which Participant may suffer, arising in whole or in part out of Participant’s participation in the Activity. By agreeing not to sue, the Undersigned are releasing any right to make a claim or file a lawsuit against any Released Party. Also, the Undersigned AGREE TO HOLD HARMLESS AND RELEASE EACH AND EVERY RELEASED PARTY FROM ANY AND ALL LIABILITY and/or claim for injury or death to persons or damage to property arising from Participant’s participation in the Activity, including, but not limited to, those claims based on any Released Party’s alleged or actual NEGLIGENCE or BREACH of any contract and or express or implied WARRANTY.
  • By execution of this Agreement, the Undersigned also AGREE TO DEFEND AND INDEMNIFY/REIMBURSE each Released Party from any and all claims of the Undersigned and/or a third party arising in whole or in part from Participant’s participation in the Activity.
  • In the case of a minor Participant, the undersigned parent or guardian acknowledges that he/she is not only signing this Agreement on his/her behalf but that he/she is also signing on behalf of the minor and that the minor shall be bound by all terms of this Agreement. Additionally, by signing this Agreement as the parent or guardian of a minor Participant, the parent or guardian understands that he/she is also waiving certain rights on behalf of the minor that the minor otherwise may have. The Undersigned parent or guardian agrees that but for the foregoing, the minor Participant would not be permitted to participate in the Activity.
  • By signing this Agreement without a parent or guardian’s signature, Participant under penalty of fraud represents that he/she is at least 18 years of age. If signing as the parent or guardian of a minor Participant, signing adults represents that they are a legal parent or guardian of the minor Participant.
  • I authorize the use by Mid Ireland Adventure or anyone authorized by Mid Ireland Adventure or any and all photographs or video footage taken of me during my participation in one of their programs/flyers, website, or social media.
  • The Undersigned understand and acknowledge that this Agreement is a contact and shall be binding to the fullest extent permitted by law. If any part of this Agreement is deemed to be unenforceable, the remaining terms shall be an enforceable contract between the parties. It is the Undersigned’s intent that this Agreement shall be binding upon the assignees, subrogors, distributors, heirs, next of kin, executors, and personal representatives of the Undersigned.
RENTAL AGREEMENT AND POLICIES

Helmets are included in the rental and are requires to be worn at all times while riding bicycles rented from Mid Ireland Adventure Bike Rental. If a customer is seen riding the rental bicycle without a helmet, they will immediately have to return the bicycle with no refund.

Customer accepts the use of the equipment, AS IS, in good condition and accepts full responsibility for the care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and the customer agrees to pay regular shop rates and retail prices for components replaced. The clean condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats, or other parts from misuse and/or crashes.

Customer agrees to provide Mid Ireland Adventure with credit card details, for precautionary use only:  I authorize Mid Ireland Adventure to charge the credit card they have on file for me for all eventual costs in case of damages to the bicycle(s) during my rental period, comprehensive of labor, except in the case that I can demonstrate other’s faults with evidence and all necessary information for reimbursement. In case of theft, I will be responsible for reimbursing Mid Ireland Adventure BIKES & RENTALS for the original price of the bicycle(s), plus the cost of any accessories that were provided at the time of the bike rental.

Event Waiver

As a condition of acceptance of my entry to any events organized by Mid Ireland Adventure including (the Kinnitty Castle 10km Knight Run, Lough Boora Night Run, or the Off the Bloom Adventure Race), I hereby waive from myself my heirs, assigns, executors, administrators or anyone else which is associated with me in any way whatsoever, all and any claim, right or cause of action legal or otherwise, which I or they might otherwise have arising out of consequent upon my entry and or participation in the said event.

I agree that this waiver, indemnity, release, discharge, and the like (as aforementioned) shall operate in favor of and hold harmless all persons, corporations, and bodies and their employees, servants, agents contractors, representatives, and the like involved in or otherwise engaged in the promoting staging, administering, running, controlling or in any way connected with this event in whatsoever or howsoever manner in respect of all actions, suits demands, claims, proceedings, costs, expenses, liabilities and judgments and the like arising out of or in relation to my entry and or the participation in this event and whether or not the loss, injury, damage or the like is attributable to the act of any one or all of them. I hereby agree that I participate in this event solely at my own risk and that I am aware of the inherent dangers of participating in an event of this nature. I agree to follow all rules and regulations and all requests made of me by event organizers, officials, or anyone else involved in running the event. I agree that I understand the risk associated with taking part in this event.

I hereby agree that I have sole responsibility for myself, my personal possessions, my athletic equipment, and the like during the event and its related activities. I hereby attest and verify that I possess the requisite skills and am physically fit and am not suffering from any illness or conditions or another physical malady that may put me or any other person at risk during the event.

In addition, I hereby grant the Mid Ireland Adventure (MIA) organizers, its directors, officers, employees, agents, and designers non-revocable permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “Images”). I acknowledge that MIA will own such Images and further grant the MIA permission to copyright, display, publish, distribute, use, modify, print, and reprint such Images in any manner whatsoever related to MIA business, including without limitation, publications, advertisements, brochures, web site images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the Image by the MIA prior to its use. I forever release and hold the MIA harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to the use of the Images, including without limitation, claims for invasion of privacy rights or publicity.
